Extreme Toronto Sports Club (“XTSC”)
By registering for or participating in any XTSC league, event, program, tournament, clinic, or activity (collectively, the “Activities”), the participant acknowledges and agrees as follows:
The participant understands that participation in recreational and sports activities involves inherent risks, hazards, and dangers, including but not limited to: physical injury; illness or disease; slips, falls, collisions, or contact with other participants; property damage or loss; aggravation of pre-existing medical conditions; permanent disability; and in rare circumstances, serious injury or death.
The participant voluntarily accepts and assumes all inherent risks associated with participation in the Activities. The participant acknowledges responsibility for determining whether they are physically and medically able to participate safely in the Activities.
The participant agrees to: comply with all XTSC rules, policies, codes of conduct, and safety instructions; comply with all facility rules and requirements; behave in a respectful and sportsmanlike manner; and immediately cease participation if instructed to do so by XTSC staff, officials, or facility personnel.
XTSC reserves the right to suspend or remove any participant whose conduct is unsafe, disruptive, or inconsistent with league policies.
To the fullest extent permitted by applicable law, the participant releases and discharges XTSC and its directors, officers, employees, contractors, volunteers, officials, sponsors, partners, facility operators, and representatives (collectively, the “Released Parties”) from claims, demands, actions, damages, losses, costs, or expenses arising from or related to participation in the Activities, including claims arising from ordinary negligence.
This release does not apply to liability that cannot legally be excluded or limited under applicable law. Nothing in this agreement is intended to waive or limit any rights or remedies that cannot legally be waived under Ontario law, including rights under applicable consumer protection legislation.
The participant acknowledges that participation in sports and recreational activities may involve exposure to communicable illnesses, including COVID-19 and other viruses or infections. XTSC cannot guarantee that participants will not be exposed to or contract a communicable illness while participating in the Activities. The participant agrees not to participate if experiencing symptoms of illness that may pose a risk to others.
XTSC reserves the right to modify schedules, locations, divisions, start dates, game times, formats, or league operations where reasonably necessary due to: facility availability; weather conditions; public health requirements; insufficient registration; force majeure events; or other circumstances beyond XTSC’s reasonable control.
Refunds, credits, rescheduling, and related administrative decisions will be handled in accordance with XTSC policies and applicable law.
Unless the participant notifies XTSC in writing before participation, the participant consents to the use of photographs or video recordings taken during Activities for XTSC promotional, marketing, and social media purposes, without compensation.
This agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By registering for or participating in the Activities, the participant confirms that they: have read and understood this agreement; understand that they are assuming certain risks associated with participation; understand that this agreement affects certain legal rights; and agree to be bound by XTSC’s applicable rules, policies, and terms and conditions.
For participants under 18 years of age, a parent or legal guardian must agree to this waiver on the participant’s behalf.
